Remote work (home office) brings many advantages, but also specific obligations. In this article, we will look at the key issue of OSH – occupational safety and health when working from home.
In the area of OSH, the Labor Code makes no distinction between employees in the workplace or outside it. THE EMPLOYER IS RESPONSIBLE FOR THE OCCUPATIONAL SAFETY AND HEALTH OF THE WORKERS.
The employer may verify compliance with duties for remote work through an inspection of the home workplace. However, it must be taken into account that the employer's rights are limited by the Charter of Fundamental Rights and Freedoms. The employee may, but does not have to, permit such an inspection. If they do not permit it, the employer should demonstrably instruct the employee on general OSH rules. It is also advisable to obtain a solemn declaration from the employee stating that their home workplace meets OSH standards.
It is also crucial not to underestimate the area of OSH due to potential occupational accidents. The employer will first have to determine whether it is indeed a work-related injury. Be prepared for the insurance company, when processing claims from the employer's statutory insurance, to demand confirmation that the employee completed OSH training for remote work, and whether and when the employer inspected the employee's home environment.
In the event of an occupational accident during home office, the employee is entitled to the same compensation as in the case of a 'regular' work injury.
